Currently the Australian Tax Office (ATO) records allow for gender to be recorded as male or female, as well as ‘indeterminate’, which can be used by non-binary people.
If you have not legally updated your name, you are also able to ask the ATO to use your preferred name. You can also request to not have a gendered title used (eg. Ms, Mr, Mrs) without requiring further documentation.
Gender markers
You will need to update your gender markers with the ATO via post.
You need to provide one of the following supporting documents, a:
statement from a Registered Medical Practitioner or Registered Psychologist verifying your gender; or
valid passport (or other Australian travel document) specifying your preferred gender; or
birth or registered details certificate which specifies your preferred gender; or
Make sure to not mail original identity documents, as they may not be able to returned to you.

The ATO can change or remove your title over the phone by calling 13 28 61 between 8.00am–6.00pm, Monday to Friday.
There is no fee to change your gender with the ATO.
Name and title
To update your legal name with the ATO, this can be done on myGov (for those registered), by post, or over the phone by calling 13 28 61 between 8.00am–6.00pm, Monday to Friday.

To update your legal name, you will need to confirm your identity. You need to provide one of the following supporting documents, an
Australian full birth certificate – not an extract
Australian marriage certificate
Australian change of name certificate
Foreign residents who don't have an Australian identity document can supply a certified copy of one of the following:
foreign passport
foreign birth certificate
national photo identification card
foreign government-issued identification
foreign marriage certificate
foreign driver licence
To update your preferred name and change your title, you have to write to the ATO and let them know your preferred name. See a template below to inform about a change of preferred or legal name.
There is no fee to change your name with the ATO.
